S.L. 217.26 Art. 16Death of a beneficiary.

(1) Following the death of a beneficiary, in exceptional circumstances, the Agency shall be empowered to determine that the certificate issued to the said beneficiary shall be issued to an approved dependant of that deceased beneficiary in such form and subject to such conditions as the Agency may impose in its discretion. Such certificate shall be issued once the said dependant provides evidence to the Agency that the conditions imposed by the Agency and all the requirements of these regulations are satisfied in such manner as the Agency may determine.

(2) Where a certificate is issued to a dependant of a deceased beneficiary in accordance with sub-regulation (1), the provisions of sub regulations (2), (3), (4) and (5) of regulation 11 shall not apply.
