S.L. 16.18 Art. 11Data protection and confidentiality. Cap. 586.

(1) All persons entitled to access and receive information in terms of these regulations shall comply with the provisions of the Data Protection Act and relevant regulations thereunder, in relation to the information which they have accessed or received, and they shall also be subject to the obligation not to disclose any information about beneficial owners except as required or permitted by law. (REGISTER OF BENEFICIAL OWNERS – FOUNDATIONS)

(2) The Registrar for Legal Persons shall be bound to maintain confidentiality on any access to the Register of Beneficial Owners by the authorities referred to in regulation 10(1)(a) and shall not inform the foundation or the beneficial owners on whom information is sought of such access. In all other cases the Registrar for Legal Persons shall act according to these regulations and shall endeavour to do so within reasonable times.
