S.L. 12.35 · Family Court Proceedings Regulations (S.L. 12.35)
S.L. 12.35 Art. 22Power of Court upon default of parties.
PART V
Where a person fails to comply with the provisions of these regulations, including to appear before a mediator for the first session or any subsequent session, the mediator shall request a written explanation. If such explanation is not provided or is not justified, the mediator shall inform the Court by means of a note indicating the failure together with any reason submitted by that person for their absence. In any case, the Court may order the defaulting party to appear before it and justify their absence, and if the Court considers that such absence is not justified, the Court shall take such measures as it deems appropriate. In its decision with regard to any pending application before it, the Court shall duly take into account and give proper consideration to such failure and any other failure.
