Cap. 646 Art. 28Publication of administrative penalties and judgements.

(1) The Authority shall publish, on the Authority’s website, any administrative penalty that has been imposed by the

Authority against duty holders that have become final for any breaches of the provisions of this Act, any regulations made thereunder and administrative instruments or any compromise fine paid in terms of article 27, for such amount as may be determined from time to time by regulations issued in terms of this Act. Such information shall remain accessible on the Authority’s website for such period as determined by regulations made under this Act.

(2) The Authority shall publish any case relating to an offence against this Act or any regulations made thereunder by a duty holder on the Authority’s website that have been decided against duty holders. Such publication shall remain accessible on the Authority’s website until such time that it is removed from the conduct certificate of the said duty holder.

(3) Such publications shall include the following information:

(a) information on the type and the nature of the breach;

(b) the identity of the duty holder involved;

(c) the amount of any administrative penalty imposed;

(d) a summary of the breach or offences committed; and

(e) the Court’s or Tribunal’s decision, as applicable, and any pertinent detail related to the case.

(4) The Authority shall update and maintain such publications in a timely manner, ensuring accuracy and accessibility to the public.

(5) The Authority shall establish and publish policies and procedures to further regulate the publication of administrative penalties and decisions by the Courts.
