In addition to the authority to bring a non-conviction-based confiscation action against property that is found in Malta, the

Government may exercise such an action against property located outside of Malta, if the property would be subject to confiscation in terms of article 43(2)(a) if the property were found in Malta. In such a case, the Courts of Malta shall have the authority to issue an appropriate confiscation order, and the Attorney General shall have the authority to request the central authority in the country where the property is located, to register and enforce the order in accordance with that country’s domestic laws and any applicable international agreements.
