(1) Without prejudice to the rights and obligations in the the Employee (Information and Consultation) Regulations, the employer shall ensure information and consultation of the platform workers’ official representatives, or where there are no such representatives, the platform workers, on decisions likely to lead to the introduction of or substantial changes in the use of automated monitoring and decision-making systems referred to in article 17(1).

(2) For the purposes of this article, the definitions

"information" and "consultation" as provided in regulation 2 of the

Employee (Information and Consultation) Regulations shall apply. The provisions of regulations 3, 4, 7 and 8 of the Employee (Information and Consultation) Regulations shall apply accordingly.

(3) The platform workers may be assisted by the official representative, insofar as this is necessary for them to examine the matter that is the subject of information and consultation and formulate an opinion. Where an employer has more than fifty (50) platform workers in Malta, the expenses that may be incurred for the examination of the matter that is the subject of information and consultation shall be borne by the employer, provided that they are proportionate.
