Cap. 503 чл. 34Transfer of mortgage.

(1) A registered mortgage over an aircraft or share may be transferred to any person by an instrument of transfer executed by the transferor in the presence of, and attested by, a witness or witnesses; and on the production of such instrument for registration the Director General shall record it by entering in the register the name of the transferee as mortgagee, of the aircraft or share, and shall by memorandum under his hand notify on the instrument of transfer that it has been recorded by him, stating the day and hour of the record.

(2) For the purposes of article 1471 of the Civil Code, registration of the instrument of transfer of a registered mortgage of an aircraft or share made by the Director General in the Malta Aircraft Register in terms of the provisions of this article shall be deemed to constitute due notice of the assignment of such mortgage to the debtor.
